Probate: What to Expect

For individuals who have never been involved in the probate of a will, the probate process can seem complicated and time consuming. However, the process can be made much less obtrusive with the assistance of an experienced probate attorney. I help clients understand what to expect. In addition, I offer comprehensive assistance to administrators or executors of the estate.

Probate is the process by which the diseased individual's estate is administered by the court and property transferred to beneficiaries. This process is summarizes as follows:

  • The administrator/executor is appointed (the facilitator of the process)
  • The will is entered into record and validated
  • Will contests are resolved
  • The administrator locates and collects all of the property and assets
  • All statutory notifications are made
  • Some property is potentially liquidated to pay debts
  • Creditor claims of unpaid bills or debts are evaluated and paid
  • Estate taxes are filed and paid (if applicable)
  • Inheritances are transferred to beneficiaries according to the will (or intestate statutes if there is not a will)

The entire probate process can take anywhere from six months to over a year. It will depend on the complexity and size of the estate as well as the number of disputes which arise. As an experienced probate lawyer, I can guide you through the process as efficiently and effectively as possible.
